Full Terms & Business Agreement

Business: Harmelie – Pilates & Sports Massage (the “Practitioner”, “I”, “me”)
Client: The person booking / attending (the “Client”, “you”)
By booking, attending, or paying an invoice for a 1:1 Pilates session, group class, sports massage, cupping, or any related service (the “Services”), you agree to these terms.
1) Professional Standards & Scope of Practice

Qualifications: BASI-trained Pilates Student; Level 3 Sports Massage Therapist; Enhanced DBS check.

Not medical care: Services are not a substitute for diagnosis, medical treatment, physiotherapy, psychotherapy, or emergency care. If you have symptoms of a medical emergency, call 999.

Right to modify session: I may adapt exercises/techniques at any time for safety and suitability.
2) Health Disclosure, Consent & Safety

Mandatory disclosure: You must disclose all relevant medical conditions, injuries, surgeries, medications (including blood thinners), pregnancies/postnatal status, implants, allergies/skin sensitivities, and anything that may affect your ability to participate safely.

Accuracy: If information is incomplete/incorrect, I may end the session immediately for safety. Full fee remains payable (as the slot has been reserved and preparation completed).

Medical clearance: I may require GP/consultant clearance before proceeding (e.g., recent surgery, severe osteoporosis, suspected DVT, uncontrolled hypertension, acute inflammation, neurological symptoms).

Consent to touch: You understand Services may involve professional physical contact, spotting, adjustment, and/or manual therapy. You can withdraw consent at any time (verbally or by gesture).

Draping & boundaries (massage/cupping): Treatment is strictly therapeutic. You will be appropriately draped at all times. I do not provide treatment to intimate areas. Any sexualised behaviour, comments, or requests will result in immediate termination (see Section 10).
3) Results, Discomfort & Aftercare

No guarantees: Outcomes vary. I do not guarantee specific results (e.g., pain elimination, weight loss, posture changes).

Normal responses: You may experience temporary muscle soreness, fatigue, or mild bruising (including from cupping) typically within 24–48 hours. This can be normal and is not automatically evidence of injury.

Client responsibility: You are responsible for following reasonable aftercare advice and exercising within your limits.
4) Booking, Packages, and Session Use

Booking confirmation: A booking is confirmed once you receive written confirmation (message/email) and any required deposit/prepayment is received.

Packages:
-
Packages are non-refundable once the first session has been used, except where required by law.
-
Packages must be used within [X months] of purchase unless otherwise stated.

Packages are for the named client only, unless I agree a transfer in writing.

Group classes: Your place is reserved for the specific class/date/time. Late arrival may mean you can’t join if it would be unsafe or disruptive; no refund is due.
5) Prices, Travel, Parking & Home-Visit Requirements

Travel radius: Prices include travel within 2 miles of Chester (measured from CH4 9QR).

Travel surcharge: Beyond the radius, a travel fee of £10 applies (agreed at booking and shown on the invoice).

Parking/tolls: If free parking is not available, you agree to reimburse reasonable parking/tolls/permits at cost (shown on invoice or with receipt).

Home environment requirements: You must provide a safe, smoke-free, adequately heated, private space. For massage: space for a 2-metre table plus safe walking room. Pets must be secured away from the treatment area.

Safeguarding for home visits (important):You are required to list all the people (Ages, Genders) who will be in the home during the home visit
I reserve the right to decline or convert a home visit to a studio/public venue session if I feel unsafe, the address/entry situation is unclear, there are unexpected additional people present, or boundaries are not respected. This is to protect both parties. If a home visit is declined on arrival due to safety/unsuitable environment, the booking is chargeable in full.
6) Punctuality, Cancellations & No-Shows

24-hour policy: Cancellations/reschedules with less than 24 hours’ notice are charged at 100% of the session fee. (This reflects reserved time that is unlikely to be refilled at short notice. Terms must be fair and transparent under UK consumer law.)

Client lateness: Sessions end at the scheduled time regardless of arrival time. No extension/discount.

Home-visit wait time: I will wait 15 minutes maximum. After this, the session is forfeited and charged in full.

Practitioner lateness: If I’m delayed by more than 15 minutes, you may choose either:

the remaining time with a pro-rata fee reduction, or
-
a free reschedule.
-

Illness: If you have a contagious illness (fever, vomiting/diarrhoea, flu/COVID-like symptoms, new rash), you must reschedule. I may refuse to proceed on arrival for infection control; the late-cancel fee may apply if within 24 hours (at my discretion where genuine illness is evidenced).
7) Payment, Invoicing, Late Fees & Chargebacks

Due date: Invoices are due upon receipt and paid in advance unless otherwise stated in writing.

Late payments: Payments outstanding beyond 7 days incur a £10 admin fee and future bookings may be paused until the balance is cleared.

Failed payments/chargebacks: If you initiate a chargeback/payment reversal without first attempting to resolve the issue directly, you remain liable for any legitimately owed amounts plus reasonable admin costs.

Receipts: Receipts are provided on request.
8) Client Property & Liability

Personal property: You are responsible for your belongings. I am not liable for loss/damage unless caused by my negligence.

Participation risk: You agree to participate within your limits and follow instructions.

Liability limits: Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law. Otherwise, liability is limited to the value of the session fee paid for the relevant booking.
9) Online Sessions

Tech responsibility: You’re responsible for having adequate space, internet, and a safe setup.

Safety: I may stop an online session if I believe your setup is unsafe (slippery floors, inadequate space, etc.).

Recording: No recording/screen capture without written consent from both parties.
10) Conduct, Harassment & Right to Refuse Service

Zero tolerance: I may refuse or terminate service immediately if you are under the influence of alcohol/drugs, behave aggressively, act in a sexually inappropriate way, or repeatedly disregard instructions/boundaries. No refund will be issued.

Respectful communication: Threatening, abusive, discriminatory, or harassing messages (including repeated contact outside hours after being asked to stop) may result in refusal of future bookings.
11) Communication Boundaries
Business hours for enquiries: 9:00–18:00 Monday–Friday. Messages received outside these hours will be answered next business day.
12) Data Protection & Privacy

Privacy notice: I handle personal data in line with UK GDPR and will provide privacy information on request by email.

Health data: Health information is treated as special category data and receives extra protection.

Use of testimonials/photos: I will only use identifiable testimonials/images with your explicit permission.
13) Consumer Cancellation Rights
If you book online/phone, consumer “cooling-off” rules can apply to some services. However, services related to leisure activities booked for a specific date/time may be exempt from statutory cancellation rights.
14) Changes, Force Majeure & Administrative Clauses

Changes to terms: I may update these terms; the version in force at the time of booking applies.

Force majeure: I’m not liable for delays/cancellations caused by events outside reasonable control (severe weather, road closures, illness, emergencies, wars, terrorism, acts of God). You will be offered a reschedule or credit.

Severability: If any clause is unenforceable, the rest remain in effect.

Governing law: England & Wales.
